Clinical Affiliation Agreement Language
Section: Incident Reporting and Notification Requirements
A. Immediate Notification Obligations
The Clinical Site agrees to notify the University immediately, and in no event later than twenty-four (24) hours, of any Reportable Incident involving a university student. For purposes of this Agreement, "immediately" means as soon as reasonably practicable after the Clinical Site becomes aware of the incident, but in all cases within the time frames specified below.
B. Definition of Reportable Incidents
Reportable Incidents include, but are not limited to:
- Patient death occurring during or immediately following student interaction or care
- Serious patient injury or adverse event during student participation in care
- Medical errors or near-miss events involving the student
- Allegations of student misconduct, unprofessional behavior, or breach of patient confidentiality
- Student exposure to infectious diseases or hazardous materials
- Student injury occurring at the Clinical Site
- Complaints from patients, families, or staff regarding student conduct or competence
- Any student incident requiring completion of an incident report by Clinical Site staff
- Removal or suspension of a student from clinical activities for any reason
- Any actual or threatened legal action involving a student
- HIPAA violations or suspected violations involving the student
- Any situation that compromises patient safety or quality of care
C. Notification Procedures
Upon occurrence of a Reportable Incident, the Clinical Site shall:
- Immediate Notification (within 2 hours for critical incidents including patient death or serious injury):
- Contact the designated University Clinical Faculty /Clinical Coordinator at the provided phone/email associated with the program.
- Provide preliminary information about the nature and circumstances of the incident.
- Written Notification (within 24 hours):
- Submit written incident report to: clinical_incident@southuniversity.edu
- Include: date, time, location, student, program, involved parties, nature of incident, immediate actions taken, and any pending investigations
- Follow-up Documentation (within 5 business days):
- Provide complete incident investigation report
- Include any witness statements, corrective actions, and recommendations
D. University Right to Investigate
The University reserves the right to conduct its own investigation of any Reportable Incident, and the Clinical Site agrees to cooperate fully with such investigation, including providing access to relevant documentation (subject to applicable privacy laws) and personnel.
